Family blames U.S. Postal Service truck for causing crash

SHERMAN — A McKinney family is suing the United States of America, alleging insufficient measures were taken to prevent injuries in a crash with a U.S. Postal Service vehicle.

Jeffrey P. Kasprzyk, individually and as next friend of Audrey L. Kasprzyk, Jeffrey D. Kasprzyk and Matthew C. Kasprzyk filed a lawsuit April 25 in the Sherman Division of the Eastern District of Texas against the United States of America, alleging negligence when the government's mail truck stuck the plaintiffs' vehicle.

According to the complaint, on April 25, 2014, the four plaintiffs suffered personal injuries when their vehicle was struck by a truck owned by the U.S. Postal Service as they prepared to turn into the Tuscany apartment complex in McKinney. The plaintiffs allege Postal Service driver Justin Loftice failed to control his vehicle and exercise caution when operating his truck.

The suit says the plaintiffs sustained a variety of injuries, medical expenses and loss of earning capacity.

The Kasprzyk family seeks damages of up to $50,000 for each of the plaintiffs, interest at the applicable legal rate, all legal fees and any other relief the court deems just. They are represented by attorneys David F. Freudiger and W. Mark Montgomery of Law Offices of Mark Montgomery in McKinney.
