Workers allege personnel business failed to pay overtime

HOUSTON — Two employees are suing a Texas personnel business, alleging failure to pay overtime wages.

Darryl Robinson Jr. and Dominick Robinson filed a class action lawsuit, individually and on behalf of all others similarly situated, April 5 in the Houston Division of the Southern District of Texas against Pacesetters Personnel Services Inc., alleging, violation of the Fair Labor Standards Act by failing to fairly compensate employees.

According to the complaint, between June 30-Dec. 15, 2015, Darryl Robinson Jr. and Dominick Robinson worked for more than 40 hours per week but were not paid any overtime by the defendants as is required by FLSA. The plaintiffs allege Pacesetters Personnel failed to pay overtime wages to any of their employees even though they worked between 10 and 12 hours per day.

The Robinsons seek a trial by jury, damages and restitution for all unpaid wages, unpaid overtime compensation, liquidated damages, interest at the highest rate permitted by law, all legal fees and any other relief the court deems just. They are represented by attorney Taft L. Foley II of The Foley Law Firm in Houston.
