Employee accuses furniture business of wrongful termination

SHERMAN — A Texas woman is suing a furniture business, alleging discrimination led to her being fired. 

Helena Nicholson filed a lawsuit May 3, in the Sherman Division of the Eastern District of Texas against TXFM, Inc., doing business as Nebraska Furniture Mart, or Nebraska Furniture Mart of Texas, or a Nebraska Furniture Mart Texas, alleging discrimination and wrongful termination in that she was fired because of her health condition.

According to the complaint, in 2015 Nicholson began suffering from a sleep disorder, which caused her to fall asleep at work in the defendant's facility in Collin County. The suit after she fell asleep at work July 20, 2015, instead of discussing her health condition, Nebraska Furniture discharged her that day. 

The plaintiff alleges the defendants discharged her as a result of her disability.

Nicholson seeks, a trial by jury, actual damages, lost wages and benefits, compensatory damages in the maximum allowed by the law, liquidated and punitive damages, interest, all legal fees and any other relief the court deems just.
