Dallas worker accuses drilling company of not paying overtime

HOUSTON — An employee is suing a drilling company, alleging the defendant did not pay overtime. 

Kyle Rak of Dallas, individually and on behalf of others similarly situated, filed a class action lawsuit April 29, in the Houston Division of the Southern District of Texas against Maersk Drilling USA Inc. alleging violation of the Fair Labor Standards Act in failing to compensate employees the legal amount of wages.

According to the complaint, since March 25, 2014, Rak, a hydraulic mechanic, has worked more than 40 hours per week but has not been paid any overtime compensation. The plaintiff alleges Maersk has knowledge of the total hours the plaintiff is working but failed to pay overtime to Rak and his fellow employees.

Rak seeks a trial by jury, declaratory and/or injunctive relief, compensatory damages, liquidated damages, interest, legal fees and any other relief the court deems just. He is represented by attorney Charles L. Scalise of Ross Law Group in Austin.
