Painter alleges industrial cleaning business ignored overtime regulations

HOUSTON — A Texas worker is suing an industrial cleaning business, alleging failure to pay overtime wages.

Jose Arredondo, individually and on behalf of of members of the class, filed a lawsuit May 10 in the Houston Division of the Southern District of Texas against J.M. Holm & Co. Inc., and Todd Nelms, alleging violation of the Fair Labor Standards Act in its failure to fairly compensate employees with overtime pay.

According to the complaint, between 2002 and August 2015, Arredondo often worked more than 40 hours per week as a painter but was not paid accordingly. The plaintiff alleges the defendants failed to pay overtime compensation to employees at the appropriate rate as defined by the FLSA.

Arredondo seeks unpaid wages and unpaid overtime compensation, liquidated damages equal to the unpaid overtime wages, interest, all legal fees and any other relief the court deems just. He is represented by attorneys Mark Siurek and Patricia Haylon of Warren & Siurek LLP in Houston.
