Contract 06

MARSHALL — Two Texas men are suing a Florida woman, alleging she failed to return $500,000.

Marvin W. Hartt and Jeff D. Thomas, both of Texas filed a lawsuit May 13 in the Marshall Division of the Eastern District of Texas against Rosetta Clevenstine alleging breach of contract.

According to the complaint, on June 25, 2010, the parties entered a partnership agreement. However, following the death of Clevenstine's husband, the suit says, the defendant owed the plaintiffs money from a distribution. The plaintiffs allege Clevenstine did not return the $500,000 that was to be distributed to each plaintiff.

Hartt and Thomas seek judgment of $333,333.32, exemplary damages, interest, all legal fees and any other relief the court deems just. They are represented by attorney Ron Adkison of Adkison Law Firm in Henderson.
