Employee alleges Houston business failed to pay overtime

HOUSTON — An Ellis County woman is suing a Houston business, alleging failure to pay overtime wages. 

Sandra Marshall filed a lawsuit May 13 in the Houston Division of the Southern District of Texas against Star Brokerage Inc., Kenneth R. Holzheauser, and Barbara Tarr, alleging violation of the Fair Labor Standards Act in failing to fairly compensate employees.

According to the complaint, between March 1, 2014 and April 15, 2016, Marshall worked more than 40 hours per week but was not paid any overtime compensation. The plaintiff alleges the defendants failed to pay overtime wages to any employee for hours worked more than 40 per work week. The suit says when Marshall inquired about the unpaid overtime, the defendants asked the plaintiff to choose between being a part-time employee or quitting.

Marshall seeks unpaid overtime compensation, liquidated damages, compensatory and liquidated damages for retaliation, interest at the highest applicable rate, all legal fees and any other relief the court deems just. She is represented by attorney Douglas B. Welmaker of Dunham & Jones PC in Austin.
