Server alleges she is owed wages from Tuscanos Brazilian Grill

HOUSTON – A Pearland woman alleges that she was not properly paid while working at a Sugar Land restaurant and has filed a class-action suit.

Heather Arce filed a complaint on behalf of all others similarly situated on May 31 in the Houston Division of the Southern District of Texas against Tucanos Development LLC, doing business Tucanos Brazilian Grill alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between 2013 and June 2014, she worked for more than 40 hours per week without receiving overtime compensation at the legal rate as defined by the FLSA. The plaintiff holds Tucanos Development LLC responsible because the defendant allegedly failed to pay minimum wage at the legal rate as well as overtime wages.

The plaintiff requests a trial by jury and seeks unpaid overtime wages, payment of the required minimum wage, all damages, liquidated damages, interest, all legal fees and any other relief as this court deems just. She is represented by Joe Williams of The Law Offices of Joe M. Williams & Associates PLLC in Houston.
