HOUSTON — An employee is suing a Texas company, alleging refusal to pay overtime wages.

Ernesto Marquez, filed a complaint, individually and on behalf of all others similarly situated, June 1 in the Houston Division of the Southern District of Texas against Layne Christensen Company alleging violation of the Fair Labor Standards Act and the New Mexico Minimum Wage Act in failing to fairly compensate employees.

According to the complaint, between 2013 and 2016 Marquez worked more than 40 hours per week but was not paid any overtime wages. The plaintiff alleges the defendant failed to pay overtime compensation to employees regardless of the total hours they worked.

Marquez seeks a trial by jury, all unpaid wages, liquidated damages, all legal fees, interest, and any other relief the court deems just. He is represented by attorneys Michael A.
