MARSHALL — A Florida man is suing a trucking company and one of its drivers, alleging negligence led to the plaintiff suffering injuries. 

Charles Stalter, of Hill, Florida, filed a complaint on June 21, in the Marshall Division of the Eastern District of Texas against RWI Transportation LLC and Ronald Hannibal, alleging negligence in failing to obey traffic rules and regulations.

According to the complaint, on Nov. 11, 2014, while Stalter was lying in the sleeping berth of his 2009 Peterbilt tractor at Pilot Travel Center No. 157, 1200 S. Hillcrest Drive, Sulphur Springs. The suit says Hannibal, who was driving a tractor owned by RWI Transportation, backed into Stalter's tractor trailer, causing the plaintiff to be thrown from the sleeping berth, resulting in personal injuries and damages. 

The lawsuit states Stalter suffered pain and mental anguish, impairment, disfigurement, loss of wages and medical expenses.

The plaintiff alleges Hannibal failed to keep proper lookout, failed to timely and properly apply brakes, failed to maintain a safe distance and failed to properly and prudently control the speed of defendant’s vehicle. The lawsuit states RWI was negligent in failing to instruct, supervise and control its driver.

Stalter seeks a trial by jury, actual damages of at least $75,000, punitive/exemplary damages, pre-judgment and post-judgment interest, legal costs and such other relief to which he is justly entitled. He is represented by Joe M. Worthington and Jimmy M. Negem of Negem & Worthington in Tyler.
