HOUSTON — A Texas man is suing an energy company, alleging failure to pay proper overtime wages.

Cody Burnside, individually and for all others similarly situated, filed a class action lawsuit June 24 in the Houston Division of the Southern District of Texas against Helmerich & Payne Inc., alleging violations of the Fair Labor Standards Act.

According to the complaint, between March 2014 and September 2015 Burnside worked as a roughneck for Helmerich & Payne longer than 40 hours per single week without proper compensation. The plaintiff alleges the defendant required Burnside to arrive at least 30 minutes before work, required him to attend mandatory meetings, refused to compensate him at a rate not less than one and one-half of his regular rate for all hours worked more than 40 per week and failed to keep proper time records.

Burnside seeks a trial by jury, all unpaid wages, liquidated damages, attorney fees, legal costs, pre-judgment interest and all other relief to which he is justly entitled. He is represented by attorneys Kelly E. Cook, Brad T. Wyly and Michael Bins of Wyly & Cook PLLC in Houston.
