Driver files suit against WW Transport of Union Parish, employee after accident

MARSHALL – A Harris County woman alleges she was injured when she was rear-ended by the driver of a tractor-trailer.

Crystal Coleman filed a complaint on July 6 in the Marshall Division of the Eastern District of Texas against Kenneth Wayne Wade and WW Transport of Union Parish alleging negligence.

According to the complaint, the plaintiff alleges that on Feb. 12, while she was driving and traveling northeast on U.S. 79 when Wade rear-ended her vehicle, causing extensive damage to her automobile and severe personal injuries to her person. She alleges her injuries caused her to suffer physical pain and suffering, physical impairment, mental anguish, disfigurement, loss of enjoyment of life, loss of earnings, loss of earning capacity, and medical expenses.

The plaintiff holds Kenneth Wayne Wade and WW Transport of Union Parish responsible because the defendant WW Transport allegedly negligently entrusted defendant Wade with the tractor-trailer. Defendant Wade is alleged to have failed to control the speed of the vehicle, failed to to maintain a proper lookout, failed to take proper evasive action to avoid accident and negligently used a cellular telephone while driving.

The plaintiff requests a trial by jury and seeks that defendants be required to appear and answer this complaint, judgment against defendants, jointly and severally, and recover all damages allowed by law, pre- and post-judgment interest, punitive damages, costs of court, and such other and further relief, at law or in equity, to which she may show herself justly entitled.
