MARSHALL — A Louisiana man is suing Tyson Foods, alleging its negligence caused injuries to the defendant.

V.L. Griffin Jr. of Mansfield, Louisiana, filed a lawsuit July 6 in the Marshall Division of the Eastern District of Texas against Tyson Foods, Inc. alleging negligence, failure to warn and not providing a safe workplace environment for its employees.

According to the complaint, on Dec. 10, 2015, while working in the blast tunnel at Tyson's facility in Center, Texas,, where racks of processed chicken are pushed through the tunnel and are blast frozen at temperatures below freezing, Griffin right pinky finger became frostbitten due to the lack of properly insulated gloves. The lawsuit states the plaintiff complained of pain to the plant's nurses station but was told the finger would be fine in a few days.

Shortly thereafter, the suit says, Griffin's finger was amputated in order to prevent further infections. The lawsuit states Griffin sustained pain and suffering, mental anguish physical impairment and medical expenses.

The plaintiff alleges Tyson failed to properly train, supervise, warn and or provide necessary instruments for its employees.

Griffin seeks a trial by jury, compensatory damages in an amount that exceeds the court's minimum jurisdictional limits, pre- and post-judgment interest, legal costs and such other relief to which he is justly entitled. He is represented by attorney Josh B. Maness of Waskom.
