Worker accuses drywall business of not paying proper overtime wages

HOUSTON — A Harris County man is suing a drywall business, alleging failure to pay overtime.

Raul Gonzalez filed a lawsuit July 8 in the Houston Division of the Southern District of Texas against Magnum Drywall Inc. and Jason Scott Michot, alleging violation of the Fair Labor Standards Act.

According to the complaint, while employed by Magnum Drywall, from October 2013 until December 2015, Gonzalez regularly worked nine hours each day, but was not properly compensated for his extra hours. The plaintiff alleges the defendants failed to pay his overtime compensation at the rate of one and one-half times his regular hourly rate for all hours worked more than 40 hours per week as required by the FLSA.

Gonzalez seeks a trial by jury, all unpaid overtime compensation, an equal amount of liquidated damages, attorney fees, legal costs and expenses, pre- and post-judgment interest and such relief allowed by law. He is represented by attorneys Mark Siurek and Patricia Haylon of Warren & Siurek LLP in Houston.
