Worker alleges Dow Chemical negligence caused burns

GALVESTON — A Texas man is suing Dow Chemical Company, alleging its negligence caused the plaintiff to sustain injuries.

Nazario Escudero filed a lawsuit July 12 in Galveston County District Court against The Dow Chemical Company, alleging negligence in failing to provide a safe working area.

According to the complaint, on July 25, 2014, Escudero was working at Dow's Plant B in Clute when a pipe leaked causing him to be exposed to the chemical Epichlorohydrin. The suit says he sustained burns in his arm and back that resulted in medical costs and damages, loss of earning capacity, pain and mental anguish, and disfigurement. 

The plaintiff alleges Dow failed to warn him of the dangerous conditions, failed to properly secure and maintain plant equipment and failed to have a safe evacuation procedure.

Escudero seeks a trial by jury, monetary relief between $200,000 and $1 million plus interest, legal costs, pre-judgment interest and such other relief as the court deems just and proper. He is represented by attorneys Michael E. Pierce and M. Paul Skrabanek of Pierce Skrabanek Bruera PLLC in Houston.
