Pharmacist accuses Walmart of discrimination

TYLER — An Athens pharmacist is suing Walmart, alleging discrimination and retaliation.

Don Lewis of Athens filed a lawsuit July 15 in the Tyler Division of the Eastern District of Texas against Walmart Stores Texas LLC, alleging violation of the Family Medical Leave Act.

According to the complaint, on Nov. 25, 2015, Lewis was terminated after nine years of faithful and exemplary service as a pharmacist for Walmart. The suit says the termination caused the plaintiff to suffer a damaged reputation, emotional distress, humiliation, embarrassment, lost wages, lost benefits, lost sleep, medical and pharmaceutical treatment. 

The lawsuit says Walmart discriminated against Lewis because of his age and medical condition.

The plaintiff alleges Walmart unlawfully retaliated against him for exercising his rights and/or reporting unlawful conduct and terminated his employment Nov. 25, only one month after his return from his prescribed medical leave of absence.

Lewis seeks a trial by jury, damages, attorney fees, legal costs, interest and such other relief as is just and equitable. He is represented by attorney William S. Hommel Jr. of Hommel Law Firm in Tyler.
