HOUSTON — An Alabama state bank is suing two Harris County guarantors, alleging breach of contract.
Compass Bank filed a complaint July 18 in the Houston Division of the Southern District of Texas against
Daniel Kirk and Kirk Lane,
alleging failure to perform their obligations under the contract.
According to the complaint, on Sept. 16, 2015, the bank provided Big Dog Logistics LLP with a working capital line of credit up to $625,000, which was guaranteed by defendants. As of July 12, 2016, the suit says, Big Dog has an unpaid balance of $470,198.22.
The plaintiff alleges the Kirks entered into a valid and enforceable contract and have waived notice and demand for payment.
Compass Bank seeks trial by jury, payments for all amounts due and owing, attorney fees, costs of court, pre-judgment and post-judgment interest and all other equiitable relief.
