Bowie County woman alleges ex-employer failed to pay overtime

Late 05

TEXARKANA — A Bowie County woman is suing her former employer, alleging failure to pay proper overtime.

Tina Hambleton filed a lawsuit July 22, in the Texarkana Division of the Eastern District of Texas against Trilok at New Boston Inc. and Balakumar Periyasamy of Virginia, alleging violation of the Fair Labor Standards Act.

According to the complaint, between January and July 2016, during one or more weeks of her employment, Hambleton worked more than 40 hours a week without receiving overtime compensation.

The plaintiff alleges the defendants failed to pay her one and one-half times her regular rate of pay for each overtime hour worked as required by FLSA.

Hambleton seeks trial by jury, damages, service awards, liquidated damages, attorney fees and litigation expenses, pre-judgment interest and any other relief the court finds proper. She is represented by attorneys Thomas H. Padgett Jr. of Ross Law Group in Bellaire, and by Charles L. Scalise and Daniel B. Ross of the same law firm in Austin.
