Insurance company alleges pediatric dentist breached contract

SHERMAN — An insurance company is suing a Collin County pediatric dentist, alleging breach of contract.

Canada Life Insurance Company filed a lawsuit Aug. 2, in the Sherman Division of the Eastern District of Texas against Dr. Tamela L. Gough of McKinney, alleging she refused to comply with the provisions of physical examinations.

According to the complaint, Canada Life has suffered financial damages for paying the defendant's total disability benefits from April 1, 2015 to Feb. 1, 2016, plus 18 percent interest, attorney fees and court costs. 

The suit says the plaintiff has also continued to pay Gough's benefits each month since February 2016. 

The plaintiff alleges Gough intentionally refused to perform under the physical examinations provision and that the defendant's lawyer interfered with the IME doctor's examination and intimidated the doctor and his staff.

Canada Life Insurance seeks a trial by jury, that Gough be served with process and be required to answer in the time and manner prescribed by law, reasonable attorney fees and legal costs, plus all relief to which it is justly entitled. It is represented by attorney Keith Verges of Figari & Davenport LLP in Dallas.
