Worker accuses former employers of unpaid overtime wages

SHERMAN — A Texas man is suing his former employers, alleging failure to pay overtime wages.

Carl Carlile filed a lawsuit Aug. 2 in the Sherman Division of the Eastern District of Texas against One Source GP LLC, Lloyd Burgess and Nancy Branson, alleging violation of the Fair Labor Standards Act.

According to the complaint, between Feb. 1, 2010, and June 17, 2016, Carlile regularly worked 40 or more hours a week for the defendants without receiving overtime premium. The suit says Carlile regularly received after-hours calls and messages from managers and drivers and was required to respond promptly and perform work-related tasks. 

The plaintiff alleges the defendants failed to compensate him at the rate of time and a half his regular rate of pay for extra hours he worked outside of his regular shifts, in violation of FLSA.

Carlile seeks a trial by jury, unpaid back wages, liquidated damages, attorney fees, costs of action, pre- and post-judgment interest and all relief as is necessary. He is represented by attorneys Jay Forester and J. Derek Braziel of Lee & Braziel LLP in Dallas.
