Maintenance supervisor alleges employer failed to pay overtime

HOUSTON — A Pearland man is suing a Houston business, alleging failure to comply with federal overtime pay regulations. 

Raymond Kerr filed a lawsuit Aug. 4 in the Houston Division of the Southern District of Texas against Metal Improvement Company LLC, doing business as Curtiss-Wright alleging, violation of the Fair Labor Standards Act.

According to the complaint, Kerr, a maintenance supervisor, was not paid overtime compensation for all hours he worked in excess of 40 in a given week. The plaintiff alleges the defendant failed and refused to pay him time and one-half for each hour he worked of more than 40 per week as required by FLSA.

Kerr seeks a trial by jury, compensation for all unpaid hours worked, liquidated damages, attorney fees, legal costs and expenses and all other relief as is required by law. He is represented by attorneys Daryl J. Sinkule and Mark G. Lazarz of Shellist | Lazarz | Slobin LLP in Houston.
