Motorist blames trucking company, driver for causing wreck

MARSHALL — A Franklin County woman is suing a trucking company and its employee, alleging negligence in causing an accident that led to injuries for the plaintiff. 

Mercedes Contreras filed a lawsuit Aug. 4 in the Marshall Division of the Eastern District of Texas against Royal Cargo Corp. and Leyvis Turino Ortega, alleging negligence in that Ortega failed to maintain proper control of his vehicle.

According to the complaint, on April 8, Contreras was driving westbound on Interstate Highway 30 when a Royal Cargo truck driven by Ortega struck the rear side of the plaintiff's vehicle, causing her to sustain severe and permanently disabling injuries, plus lost wages. 

The plaintiff alleges Ortega failed to maintain proper lookout, failed to maintain a safe distance, and failed to apply brakes in a timely manner to avoid the accident.

Contreras seeks trial by jury, judgment, jointly and severally, for actual damages, plus pre- and post-judgment interest, costs of court and all relief to which she is entitled. She is represented by attorney Jimmy Negem and Joe Worthington of Negem & Worthington in Tyler.
