Financial coordinator alleges orthodontist failed to pay overtime

HOUSTON — A Houston woman is suing a local orthodontist, alleging failure to pay proper overtime wages. 

Keely Fuller filed a class action lawsuit, individually and on behalf of all others similarly situated, Aug. 10 in the Houston Division of the Southern District of Texas against Dr. Vladimir Tabakman, doing business as West Houston Orthodontics, alleging violation of the Fair Labor Standards Act.

According to the complaint, between April 16, 2015-March 20, 2016, Fuller worked as a financial coordinator 60 hours per week without overtime compensation. The suit says she was paid a regular hourly rate of $17 per hour. 

The plaintiff alleges West Houston Orthodontics failed to pay the statutory rate of one and one-half times her regular rate for all hours worked of more than 40 per week, failed to keep or record time records and failed to compensate for work performed off the clock as required by FLSA.

Fuller seeks a trial by jury, an order for the defendant to pay the difference between what it should have paid for overtime hours, damages for retaliation, attorney fees and court costs, post-judgment interest and all relief as is necessitated. She is represented by attorney Taft L. Foley II of The Foley Law Firm in Houston.
