Plano merchant services provider alleges call center company owes $109,000

SHERMAN — A Plano merchant services provider is suing a Nevada-based call center company, alleging it owes more than $109,000. 

Pivotal Payments Inc. filed a lawsuit Aug. 11 in the Sherman Division of the Eastern District of Texas against Taking You Forward LLC, alleging breach of agreement by repudiating its obligations.

According to the complaint, on Nov. 3, 2014, Pivotal Payments  entered into a contract for services agreement with Taking Your Forward, and on Jan. 27, 2016, it provided 30-days’ notice of termination of the agreement to the defendant. 

The suit says the defendant retaliated, informing Pivotal Payments it would ramp down immediately to a skeletal contractual staff. For these reasons, the lawsuit states, the plaintiff immediately in-sourced its contact center services, causing consequential damages in the amount of not less than $25,000. 

On Feb. 24, 2016, Pivotal Payments demanded the return of the balance of the plaintiff's security deposit of $84,093.75. The plaintiff alleges Taking You Forward failed and refused to remit the balance.

Pivotal Payments seeks trial by jury, monetary judgment not less than $109,093.75, plus pre-judgment interest, costs, expenses, attorney fees and all other relief the court deems appropriate.
