HOUSTON — A Harris County woman is suing a Houston professional staffing business, alleging failure to pay legally required overtime.
Barbara Bryant filed a class action lawsuit, individually and on behalf of all others similarly situated, Aug. 10 in the Houston Division of the Southern District of Texas against Fircroft Inc. alleging violation of the Fair Labor Standards Act.
According to the complaint, Bryant regularly worked more than 84 hours a week without receiving any premium compensation as required by FLSA. The plaintiff alleges Fircroft pays her a day rate only for all hours she worked, including those in excess of 40 in a week.
Bryant seeks trial by jury, an order finding Fircroft liable for unpaid back wages, court costs, attorney fees, unpaid benefits and compensation, pre- and post-judgment interest, and all other relief as is necessary. She is represented by attorneys Michael A. Josephson, Andrew W. Dunlap and Lindsay R. Itkin of Fibich, Leebron, Copeland, Briggs & Josephson in Houston, and by Richard J. (Rex) Burch of Bruckner Burch PLLC in Houston.
