Vocational nurse alleges former employers failed to pay overtime

GALVESTON — A Galveston County licensed vocational nurse is suing Friendswood employers, alleging failure to pay overtime wages.

Phyllis Moore filed a lawsuit Aug. 17 in the Galveston Division of the Southern District of Texas against J. Allen and Associates of Texas LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, between May 2014 and July 2016, Moore was forced to clock out for lunch even though she worked through her lunches. The suit says Moore also was required to continue working even after she clocked out and worked more than 40 hours each week but she has not been compensated for all overtime hours.

The plaintiff alleges the defendants failed to pay overtime compensation for all hours Moore worked more than 40 per week, according to FLSA regulations.

Moore seeks trial by jury, all damages, attorney fees, court costs and expenses, pre and post-judgment interest and all other relief deemed proper. She is represented by attorney Douglas B. Welmaker of Dunham Jones PC in Austin.
