New York company alleges Texas office equipment business owes nearly $100,000

HOUSTON — A New York company is suing a Victoria office equipment business, alleging it owes more than $99,000. 

Can Capital Asset Servicing Inc., formerly known as Newlogic Business Loan Inc., filed a lawsuit Aug. 16 in the Houston Division for the Southern District of Texas against Victoria Office Equipment Inc. and Phyllis Steelman, alleging failure to comply with the loan and guarantee agreement.

According to the complaint, on Jan. 9, 2015, the defendants entered into a Business Loan Agreement with WebBank for $106,696. WebBank, the suit says, assigned the agreement to Can Capital Asset. 

The lawsuit states the defendants have defaulted on payments since Dec. 21, 2015, causing the plaintiff to be damaged in the amount of $99,242.06. The plaintiff alleges the defendants have failed to make further payments.

Can Capital Asset Servicing seeks trial by jury, judgment in the amount of $99,242.06, plus attorney fees, possession of the collateral for the purpose of selling and applying proceeds to the balance due and all other relief to which it is justly entitled.
