Captain alleges ship owners' negligence led to injuries

BEAUMONT — A Texas captain is suing two ship owners, alleging their negligence led to the plaintiff suffering injuries. 

Tony Galindo of Rockwall, Texas, filed a lawsuit Aug. 10 in Jefferson County District Court against Abe's Boat Rentals Inc. of Belle Chasse, Louisiana, and WAS Marine Services Inc. of Nederland, Texas, alleging violation of general maritime law in providing an unsafe work environment.

According to the complaint, on July 6, Galindo was working aboard the M/V Miss Wynter, owned by Abe's Boat Rentals. The suit says Galindo sustained injuries to his knee and body when the M/V Capt. Stokes, owned by WAS Marine, caused a collision with the plaintiff's vessel. The lawsuit says Galindo tried to maneuver away from the Capt. Stokes by turning the wheel of the Miss Wynter but injured his knee in the process.

The suit states Galindo's injuries resulted in physical pain, disfigurement, mental anguish, discomfort, distress and loss of earning capacity. The plaintiff alleges the defendants failed to properly supervise their crews, failed to properly train their employees, failed to provide adequate safety equipment and failed to properly maintain their vessels.

Galindo seeks trial by jury, judgment in excess of the minimum jurisdictional limits of the court, pre- and post-judgment interest, attorney fees, court costs and all other relief to which he is entitled.
