Cashier alleges convenience store operator failed to pay overtime

Late 03

HOUSTON — A Texas man is suing a Houston convenience store operator, alleging violation of workers compensation acts by failing to pay overtime.

Javed Akhter filed a lawsuit Aug. 17 in the Houston Division of the Southern District of Texas against S&A Consultinh LLC, Muhammad S. Siddiqi and Mansoor Feserrozi, alleging violation of the Fair Labor Standards Act.

According to the complaint, Akhter worked as a cashier for the defendants' convenience store, a CITGO gas station in Houston, for more than 40 hours per week, but was not paid the required overtime compensation. Additionally, the suit says, he was frequently paid less than federal minimum wage, suffering a loss of wages of at least $15,000.

The plaintiff alleges the defendants failed to pay him minimum wage and overtime compensation as required by law.

Akhter seeks trial by jury, judgment equal to the plaintiff’s unpaid back wages, liquidated damages, prejudgment interest, attorney fees and all other relief the court deems just and equitable. He is represented by Kevin M. Madden of Law Offices of Kevin Michael Madden PLLC in Houston.
