MARSHALL — A Gregg County man is suing a Florida motorist, alleging his negligence caused a crash that injured the plaintiff.
Danny Allen of Longview filed a lawsuit Aug. 22 in the Marshall Division of the Eastern District of Texas against Paul Matykunas, alleging negligence in failing to exercise ordinary care and prudence to avoid an accident.
According to the complaint, on March 3, Allen was a passenger in a vehicle that was run into by a car driven by Matykunas. The suit says the collision caused Allen injuries that resulted in pain and mental anguish, loss of earnings and medical expenses.
The plaintiff alleges Matykunas failed to keep a proper lookout, failed to timely apply brakes and failed to maintain safe distance.
Allen seeks trial by jury, all damages for at least $75,000, pre- and post-judgment interest, attorney fees and all other relief. He is represented by attorney Luke F. Bickham of Tyler.
