Employee alleges industrial painting company failed to pay overtime

LUFKIN — A Willis man is suing a Lufkin industrial painting company, alleging violation of workers compensation acts.

Robert Clay Harper filed a lawsuit Aug. 29 in the Lufkin Division for the Eastern District of Texas against DSA Coatings Inc. and Leeland Max Rowe, alleging violation of the Fair Labor Standards Act.

According to the complaint, Harper worked for an average of 50 to 60 hours per week as a coatings inspector between March 1, 2006, and July 1, 2016, for DSA Coatings but was only compensated a straight-time rate, without any overtime premiums. 

The plaintiff alleges the defendants permitted him to work more than 40 hours per week but refused to compensate him time and a half premiums for all hours worked in excess of 40 per week as stipulated by FLSA.

Harper seeks trial by jury, all unpaid overtime wages, liquidated damages, attorney fees, court costs and expenses, pre- and post judgment interest and all other relief. He is represented by attorneys James M. Loren, George Z. Goldberg and Rachel Rustmann of Goldberg & Loren PA in Dallas.
