Employee alleges limo bus operator failed to pay overtime

HOUSTON — A Houston woman is suing a limo bus operator, alleging violation of workers compensation acts in its failure to pay overtime.

Felicia Smith filed a class action complaint, individually and on behalf of all others similarly situated, Aug. 29 in the Houston Division of the Southern District of Texas against R&R Partnership Inc. of Houston, alleging violation of the Fair Labor Standards Act.

According to the complaint, from August 2015 to March 2016, Smith was required to work more than 40 hours during many seven-day workweeks and was routinely required to perform work off the clock without being paid overtime compensation. 

The plaintiff alleges R&R Partnership failed to properly compensate her at a rate of one and one-half times her regular rate for hours worked in excess of 40 per week a required by FLSA and failed to keep proper time records.

Smith seeks trial by jury, an order declaring the defendant has violated FLSA, unpaid wages, attorney fees and court costs, post-judgment interest and for all further relief. She is represented by attorney Taft L. Foley II of The Foley Law Firm in Houston.
