Prospective boat buyer blames property owners for injuries

GALVESTON — A prospective boat buyer is suing Galveston County property owners, alleging the defendant's negligence led to injuries for the plaintiff.

Betty Leinbach filed a lawsuit Sept. 6 in Galveston County District Court against South Shore Harbour Development LLC and Thomas Nolan, doing business as Texas Sportfishing & Yacht Sales, alleging they failed to implement and enforce proper safety procedures.

According to the complaint, on June 25, while Leinbach was walking on the defendants' property in Galveston County, she fell from an unmarked and dangerous hole on the pier. The suit says the fall caused her to sustain severe personal injuries to her arm, wrist and other parts of her body that resulted in mental pain and anguish, permanent impairment, and medical expenses. 

The plaintiff alleges the defendants failed to maintain a safe environment, failed to inspect and/or maintain the property and failed to warn of a dangerous condition.

Leinbach seeks a trial by jury, monetary relief of more than $1 million, plus pre- and post-judgment interest, costs of court and all other relief. She is represented by attorney Sean E. O’Rourke of Simon-O’Rourke PC in Houston.
