Man alleges Scottsdale Insurance wrongfully denied coverage for home's damage

GALVESTON – A Galveston County man alleges his insurer wrongfully denied coverage for damage to his home.

Donald Clark filed a complaint on Sept. 28 in Galveston County District Court against  Scottsdale Insurance Co. and Wardlaw Claims Service LLC alleging breach of contract and violation of the Texas Deceptive Trade Practices Act and other counts.

According to the complaint, the plaintiff alleges that on Sept. 15, 2015, he sustained property damages from a plumbing leak from the shower in the second level of the bathroom of his home. He immediately filed a claim with defendant Scottsdale, who assigned Wardlaw to inspect the property.

The plaintiff holds Scottsdale Insurance Co. and Wardlaw Claims Service LLC responsible because defendant Wardlaw allegedly failed to inspect all the interior damage and defendant Scottsdale improperly partially denied coverage and continues to delay in the payment for his claim.

The plaintiff requests a trial by jury and seeks judgment against defendants for actual, treble, and exemplary damages, attorney fees, pre- and post-judgment interest, costs of suit, and all other relief. He is represented by Clint Brasher and Joe Muckleroy of Brasher Law Firm in Beaumont.
