Truck owner alleges insurance agents failed to pay proper compensation

GALVESTON — A Galveston County truck owner is suing insurance agents, alleging breach of contract in failing to properly compensate the plaintiff after a crash.

Donald Clark filed a lawsuit Sept. 28 in Galveston County District Court against Miguel Figueroa, doing business as Night Riders, and Westchester Fire Insurance Company, alleging failure to perform their contractual duty.

According to the complaint, Clark's truck was damaged during an accident while being transported. The suit says the parties approved an agreement June 15, wherein the defendants would release for consideration the full amount of $23,000.

To date, the lawsuit states, an amount of $5,000 is still uncollected. The plaintiff alleges the defendants continue to delay and refuse to pay the full amount of damages to plaintiff's property.

Clark seeks trial by jury, treble and exemplary damages, necessary attorney fees, pre- and post-judgment interest, costs of suit and all other relief. He is represented by attorneys Clint Brasher and Joe Muckleroy of Brasher Law Firm in Beaumont.
