Family blames health care providers for relative's death

TEXARKANA — The surviving spouse, parents and children of an Arkansas woman are suing health care providers, alleging the defendants' negligence caused the woman's death. 

Phillip Boswell, Raney Reynolds, Tiffany Young, Tabatha Acker, Aaron Boswell, Jessica Carter and Taylor Young filed a lawsuit Sept. 30 in the Texarkana Division of the Eastern District of Texas against Christus St. Michael Health System, Christus Surgery Associates–Texarkana, Surgery Associates of Texarkana and Dr. Dennis O’Banion, alleging breach of the recognized standard of acceptable professional practice.

According to the complaint, on Oct. 19, 2014, as a result of the defendants' negligence, Sheila Boswell of Texarkana, Arkansas, died due to cardiovascular collapse. Her untimely death, the suit says, caused the plaintiffs to suffer damages, including emotional distress, lost of affection, companionship and society. 

The plaintiffs allege the defendants failed to act with the ordinary and reasonable care that physicians and health care providers would provide, and O’Banion failed to look for other possible causes of cardiovascular collapse.

The plaintiffs seek trial by jury, actual damages of $1.5 million, pre- and post-judgment interest, costs of court and all other relief. They are represented by attorney Bill Liebbe of The Liebbe Firm PC in Tyler.
