BEAUMONT — A Jefferson County man is suing Beaumont and Jefferson County law enforcement agents, alleging the defendants beat him in violation of his federal rights.

Tomas Jesus Moraida Jr. filed a lawsuit Oct. 4 in the Beaumont Division of the Eastern District of Texas against the city of Beaumont, Jefferson County, Officer D. Wilkerson, Sergeant Bean, Officer Leger, and Officer K. Barnett alleging violation of the 14th Amendment of the U.S. Constitution.

According to the complaint, on June 27, 2016, while Moraida was being arrested for allegedly burglarizing a building, he sustained severe multiple injuries, causing him to experience excessive pain, a broken jaw, a mandible and condyle fracture, an elbow injury and loss of feeling in two fingers and left hand.

The plaintiff alleges the defendants unlawfully used excessive force in arresting him, completely disregarded his safety and constitutional rights and failed to provide any medical attention.

Moraida seeks trial by jury, actual and punitive damages, pre- and post-judgment interest, costs of court and attorney fees, plus all other relief. He is represented by attorneys Ryan Nicole Jacobs and Patrick O’Hara of Jacobs, O'Hara, McMullen PC in Houston.
