Alabama company alleges Texas contractors owe more than $2 million

SHERMAN — An Alabama-based company is suing a Texas contractor, alleging breach of contract, breach of fiduciary duty, defamation, conversion and unjust enrichment.

Clement Group LLC filed a lawsuit Oct. 7 in the Sherman Division of the Eastern District of Texas against ETD Services LLC, doing business as the Davitz Group, E. Earl Davis II and Tara Davis, alleging they failed to comply with the terms of their joint venture agreement of 2013.

According to the complaint, the defendants' actions have caused Clement Group to suffer great monetary loss, loss of business and a damaged reputation. The plaintiff alleges the defendants made multiple unauthorized withdrawals of joint venture funds, refused to return the money and failed to pay all subcontractors for work performed.

Clement Group seeks trial by jury, damages of more than $2 million, interest, attorney fees, court costs, expenses and all other relief to which it is justly entitled. It is represented by attorney Ian P. Faria of Bradley Arant Boult Cummings LLP in Houston.
