Diner alleges Landry's waiter failed to report shellfish allergy

GALVESTON – What was supposed to be dinner at a Galveston restaurant with his family last February has resulted in a personal injury lawsuit for a Houston man, recent Galveston County District Court records show.

Pete A. Herrada filed the suit against Landry’s Seafood House-San Luis, Inc. and Landry’s Inc., doing business as Landry’s Restaurants, Inc., on Nov. 1 in the Galveston County 405th District Court, stating that his meal caused him to suffer an allergic reaction.

According to the complaint, Herrada ordered crawfish etoufee and fried oysters with instructions for the waiter to make sure the food was free of any shrimp or shrimp residue.

“The waiter assured him that he would make sure his food did not contain any shrimp,” the original petition says. “After the plaintiff’s order arrived, he began eating and immediately began having an allergic reaction.”

An ambulance transported Herrada to a local hospital. Herrada’s wife learned that the waiter forgot to report the plaintiff’s shrimp allergy, the suit says.

Consequently, Herrada seeks unspecified monetary damages.

He is represented by attorney Sarnie A. Randle, Jr. of the law firm S. A. Randle & Associates in Houston.
