Office clerk alleges employers failed to pay overtime

SHERMAN — A Texas office clerk is suing her employers, alleging violation of workers compensation acts in failing to pay overtime.

Tracey Hyman filed a class action complaint, individually and on behalf of all others similarly situated, Oct. 12 in the Sherman Division of the Eastern District of Texas against GS Dallas LP., Sanjeev Khanna and David Peugh, alleging violation of the Fair Labor Standards Act.

According to the complaint, Hyman routinely worked more than 40 hours per week without being compensated for her overtime work. The plaintiff alleges the defendants classified her as exempt administrative employee, made unlawful deductions from her salary and failed to compensate her for overtime hours worked at a rate of at least one-and-one-half times her regular hourly rate as required by FLSA.

Hyman seeks trial by jury, injunctive relief, ordering the defendants to end all illegal wage practices, reimbursement for unpaid overtime wages, liquidated damages, costs of court, expenses, attorney fees and all other relief the court deems just. She is represented by attorneys Charles W. Branham III and Corinna Chandler of Dean, Omar & Branham LLP in Dallas.
