Customer alleges car dealer, agent misrepresented vehicle's title

HOUSTON — A customer is suing an a Houston car dealer and an agent, alleging breach of implied warranty of title.

Stephanie Seplavy filed a lawsuit Oct. 17 in Harris County District Court against Don Jacobson Automobiles Inc and Arnie Talisman, alleging they fraudulently represented a false certificate of title.

According to the complaint, on March 26, Seplavy purchased a 2015 Honda Fit from the defendants. The suit says the vehicle's mechanical issues affected her ability to travel and go to work. 

The plaintiff alleges the defendants misrepresented that the vehicle did not have any salvage title at the time of purchase, failed to verify the correct title of the vehicle and refused to address the misrepresentation of the car title.

Seplavy seeks trial by jury, damages in excess of the jurisdictional limits of the court, pre- and post-judgment interest, attorney fees, court costs and all other relief. She is represented by attorney Randell S. Boochoon of Donati & Brashear Law Firm in Katy.
