Galveston County resident accuses insurer of failing to pay for damages in a timely manner

GALVESTON — A property owner is suing Asi Lloyds and Pamela Dawn Boone, insurer and adjuster, citing alleged breach of contract and misrepresentation.

Katherine Kekatos filed a complaint on Oct. 18, in the Galveston County District Court against the defendants alleging that they violated the Texas Insurance Code, Prompt Payment Act.

According to the complaint, the plaintiff alleges that, on July 21, her property sustained sustained extensive damage from a washing machine leak. The property damage is currently estimated at $61,316.40. To date, she has received only $7,298.22 from defendant Asi Lloyds. The plaintiff holds Asi Lloyds and Pamela Dawn Boone responsible because defendant Asi Lloyds allegedly failed to pay in a timely manner and refused to pay the full extent of the coverage owed to plaintiff. The suit also claims that defendant Boone allegedly undervalued the damage to her property.

The plaintiff requests a trial by jury and seeks award for actual, consequential, punitive and treble damages, attorneys' fees, costs of court, pre- and post-judgment interest and for any other and further relief to which she is entitled.
