Janitor alleges former employers failed to pay overtime

HOUSTON — A janitor is suing her former employers, alleging violation of workers compensation acts in failing to pay overtime.

Maria Vasquez filed a lawsuit Oct. 18 in the Houston Division of the Southern District of Texas against The Woodlands General Contractors Inc. and Innovation Tile and Flooring LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, during Vasquez's employment with the defendants from June 2015 to July 2016, she was not paid the required overtime premium for working more than 40 hours per week. Instead, the suit says, she was paid the same rate for all hours for which she has worked. 

The plaintiff alleges the defendants failed to properly compensate her at the rate not less than one and one-half times her hourly rate for work performed of more than 40 hours per week as required by FLSA.

Vasquez seeks trial by jury, judgment for an amount equal to her unpaid overtime wages, liquidated damages, costs and attorney fees and for all other relief. She is represented by attorneys Josef F. Buenker and Vijay A. Pattisapu of Houston.
