Minor, next friend blame Galveston property owner for injuries

GALVESTON — A minor and her next friend are suing Galveston property owners, alleging negligence led to injuries to the minor. 

Kelly Wright of Fort Bend County, individually and as next friend of a minor, filed a lawsuit Oct. 21 in Galveston County District Court against Property Owners Association of Pointe West Inc., alleging failure to maintain a safe environment.

According to the complaint, on May 8, 2015, the minor sustained injuries from a broken bathroom door when she entered the women’s bathroom by the pool at the defendant’s Point West property in Galveston. As a result, the suit says, the minor sustained physical pain and mental anguish, loss of earning capacity, disfigurement and medical expenses. 

The plaintiffs allege the defendant failed to fix the broken bathroom door, failed to place warning signs and use caution signs and failed to make any attempt to notify patrons that the door was broken.

The plaintiffs seek monetary relief between $200,000 and $1 million, pre- and post-judgment interest, costs of court and all other relief to which they are justly entitled. They are represented by attorney Adam J Rosenfeld of Schechter, McElwee, Shaffer & Harris LLP in Houston.
