Gregg County motorist blames crash on national carrier, employee

MARSHALL — A Gregg County motorist is suing a national carrier and one of its drivers, alleging their negligence caused a crash that injured the plaintiff. 

Justin Laborde filed a lawsuit Oct. 21 in the Marshall Division of the Eastern District of Texas against Schneider National Carriers Inc. and Craig Stephen Demoulin of Baton Rouge, Louisiana, alleging violation of applicable state and federal motor carrier safety regulations.

According to the complaint, on May 18, a tractor-trailer rig owned by Schneider and operated by Demoulin, collided with Laborde's automobile on U.S. Interstate Highway 80 in White Oak. As a result of the collision, the suit says, the plaintiff sustained injuries that resulted in physical and mental pain, impairment and disfigurement, loss of earning capacity and health care expenses. 

The plaintiff alleges Demoulin operated the tractor-trailer rig too fast for the wet roadway conditions and failed to maintain proper control of the tractor-trailer.

Laborde seeks trial by jury, judgment against the defendants, jointly and severally, for all damages, pre- and post-judgment interest, court costs and all other equitable relief.
