General manager accuses employers of not paying overtime

HOUSTON — A Harris County man is suing his Sugar Lane employers, alleging violation of workers compensation acts in not paying overtime.

John Graves filed a lawsuit Oct. 24 in the Houston Division of the Southern District of Texas against Nalini Kannan Enterprises LLC, doing business as Decor One, and Nalini Kannan, alleging violation of the Fair Labor Standards Act.

According to the complaint, between Jan. 16, 2015, and May 29, 2016, Graves routinely worked as a general manager for the defendants 45 to 60 hours or more per week but was not paid overtime premium for all hours worked in excess of 40 for a single week. 

The plaintiff alleges the defendants misclassified him as exempt from overtime pay and failed to provide proper overtime compensation for hours he worked more than 40 per workweek as required by FLSA.

Graves seeks trial by jury, all his unpaid wages, liquidated damages, attorney fees and court cost, post-judgment interest and all other relief to which he is entitled. He is represented by attorneys Lionel Martin and Melissa Garcia-Martin of Garcia-Martin & Martin PC in Sugar Land.
