Five technicians accuse employers of failing to pay overtime

HOUSTON — Five control technicians are suing their oilfield services employers, alleging violation of workers compensation acts in failing to pay overtime.

Andre Gilbert, Chad Thomas, Justin Tombs, Randy Nicodemus and Trevor Hess filed a complaint Nov. 4 in the Houston Division of the Southern District of Texas against Kayden Industries (USA), Inc., Kayden Industries Ltd., Kayden Industries LP and Kayden Industries Inc., alleging violation of the Fair Labor Standards Act and Ohio wage laws.

According to the complaint, the plaintiffs regularly worked far more than 40 hours a week without receiving overtime payment at one-and-one-half times their regular rates within 30 days of performing the work as required by FLSA. 

The plaintiffs seek trial by jury, unpaid overtime wages, liquidated damages, attorney fees, court costs and expenses, pre- and post-judgment interest and all other relief to which they are justly entitled. They are represented by attorneys Richard J. (Rex) Burch of Bruckner Burch PLLC in Houston, and by Michael A. Josephson of Fibich, Leebron, Copeland, Briggs & Josephson in Houston.
