GALVESTON — A former employee is suing a Houston energy business, alleging violation of workers compensation acts in failing to pay proper overtime.

Christopher Moten, individually and on behalf of all others similarly situated, filed a class action complaint Nov. 9, in the Galveston Division of the Southern District of Texas against FMC Technologies Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, Moten routinely worked more than 40 hours per week as an installation engineer for the defendant without being paid overtime. The plaintiff alleges FMC Technologies deliberately failed to compensate his overtime for all hours worked in excess of 40 hours per week in an amount equal to one-and-a-half times his regular rate of pay as required by FLSA.

Moten seeks trial by jury, an order recognizing this proceeding as a collective action, unpaid back wages due, liquidated damages, attorney fees, costs of court and all other relief as is necessary.
