Delivery driver alleges pizza restaurant operators violated wage laws

SHERMAN — A delivery driver is suing operators of a McKinney pizza restaurant, alleging unlawful wage deduction and violation of applicable minimum wage laws.

John Michael Redus, individually and on behalf of others similarly situated, filed a class action complaint Nov. 15 in the Sherman Division of the Eastern District of Texas against Tumbleweed Pizza Partners LP and Pizza Hut of America LLC, alleging the defendants unlawfully deducted job related expenses and violated the Fair Labor Standards Act (FLSA).

According to the complaint, Redus suffered monetary damages purchasing gasoline, automobile insurance, repairs, maintenance services, uniform items and cellular phone services and suffered automobile depreciation and other job-related expenses for the benefit of defendants. 

As a result, the suit says, Redus was deprived of the minimum wage income. The plaintiff alleges the defendants failed to maintain accurate records of job-related expenses and deductions, and failed to pay minimum wages as required by the FLSA.

Redus seeks judgment finding the defendants liable for unpaid back wages, liquidated damages, costs of this action and all other appropriate relief. He is represented by attorneys J. Derek Braziel, J. Forester and Travis Gasper of Lee & Braziel LLP in Dallas.
