HOUSTON — A customer is suing New York state costume makers, alleging deceptive and unfair trade practices in not providing promised costumes.
E. V. Drake of Houston filed a lawsuit Dec. 8 in the Houston Division of the Southern District of Texas against Costumer Armour Inc. and Christo Vac of Cornwall, New York, and Drake Loeb PLLC, alleging violation of the Texas Deceptive Trade Practices Act.
According to the complaint, on Feb. 1, 2015, Drake forwarded $1,600 to Costumer Armour to make costumes. The suit says Drake did not receive any costumes, even the poorly crafted ones, causing the plaintiff to suffer mental distress.
The plaintiff alleges Costumer Armour failed to make any costumes that Drake ordered and failed to refund any part of his money.
Drake seeks trial by jury, compensatory damages with interest, attorney fees, court costs and all other reasonable relief. The plaintiff is representing himself.
